遺言公正証書を作成する予定なのですが、公証センターから事前に診断書を提出するようにいわれました。病名を記載する、名前を言うことが出来る、の出来る出来ないのチェックなら、医師に任せても良いと思います。ただ、この診断書には「当院において治療中であるが、意思表示が明確にでき、判断能力に問題がないことを証明する。」「なお、遺言又は契約など自己の財産を単独で管理・処分する能力を有しているものと認められる。」と記載されています。この診断を医師に求めるのは、酷というか、特に高齢者に関しては出来ないのではないか、そもそも医師の仕事ではないと思います。
