２、信託財産の管理方法

（１）受託者は、受益者からの指図により、信託財産を処分することができる。

受託者による信託の清算手続は、信託財産の全てを、これに関する一切の債権債務関係と共に、残余財産の帰属権利者に引き渡したときに終了する。

自己信託設定公正証書（案）
本公証人は、Aの嘱託により、次の法律行為に関する陳述の趣旨を録取し、この証書を作成する。
（信託の設定）
第１条 信託設定者A（以下、「甲」という。）は、本証書に記載する目的に従い、第３条記載の財産について、受益者のために、当該財産の管理その他本信託目的の達成のために必要な行為を行うものとして自ら信託を設定します（以下「本信託」という。）。
また、甲は本信託が受益者以外の債権者を害しないこと及び本信託を設定するに当たり充分な資力を持つことを表明します。
（信託の目的）
第２条 甲は、第３条記載の財産を信託財産として管理を行い、もって甲およびその家族の安定した居住生活の確保を目的とします。
（信託財産）
第３条 本信託の当初信託財産は、下記の第１号及び第２号とします。また、将来において第３号から第５号の財産も信託財産とします。
一 別紙「信託財産目録」第１記載の不動産の所有権（以下「信託不動産」という。）
二 別紙「信託財産目録」第２記載の金融資産（以下「信託金融資産」という。）
三 信託財産より生じる一切の果実
四 銀行 支店より融資が予定されている 万円の金銭債権
２ 本条第３号から第４号によって発生した金銭については、第１項第２ 号の信託金融資産に算入します。
（信託設定者）
第４条 自己信託を設定する者の住所及び氏名は、次のとおりとします。

第５条 本信託の受益者（「以下「受益者」という。」）は、次の者とします。

２ 受益者は、本信託の効力発生時に受益権を取得します。
（信託不動産の管理）
第６条 甲は、信託不動産について信託による所有権変更または所有権移転及び信託の登記手続を行います。
２ 受益者は、火災保険契約の締結、境界確定、修繕など信託不動産の価値の維持及び向上を見込むことができる措置について、受託者に対し指図することができます。
３ 第２項の費用およびその他の必要経費については、受託者が信託金融資産から支払います。
（信託金融資産の管理および利用方法の制限）
第７条 受託者は信託金融資産について、信託に必要な表示または記録等を行い、事業資金または投資目的に利用しません。
（後継受託者）
第８条 甲の後継受託者は、Aの子である次の者とします。

（信託の終了）
第９条 本信託は、以下の各号のいずれかに該当したときに終了します。
一 甲と受益者が合意したとき
二 甲が死亡した時
三 その他信託法の定める信託終了事由に該当するとき
（信託の清算）
第１０条 本信託が終了した場合、清算受託者は次の順で職務を行います。
一 信託債権に係る債務がある時は、その弁済
二 受益債券に係る債務がある時は、その弁済
三 信託財産が残る場合は、残余財産受益者への給付
（残余財産受益者）
第１１条 本信託終了時の残余財産受益者は、甲とします。
（信託の変更）
第１２条 本信託の規定は、甲または後継受託者と受益者の書面による合意により、変更することができます。
（信託財産責任負担債務）
第１３条 甲が、下記の者から借り入れた金銭につき、その全額を信託財産責任負担債務とします。
