２、信託財産の管理、運用及び処分の方法

（１）受託者は、受益者又は受益者代理人からの指図により、信託財産を処分することができる。

３、信託の終了 : Termination of the trust.
本信託の終了事由は、下記の通りである。

（１）受益者又は受益者代理人が合意した時。
: (1) If the trustee and the beneficiary’s agent agree to termination of the trust, the trust terminates.
（２）信託法に定める事由が生じた時。
: (2) If the grounds in the trust act occur, the trust terminates.
４、委託者の地位は、その相続によって消滅する。

５、信託の変更 : Modification of the trust.
本信託は、受託者および受益者又は受益者代理人との合意により、変更することができる。

６、清算手続の終了 : Termination of liquidation procedure of the trust.
受託者による信託の清算手続は、信託財産の全てを、これに関する一切の債権債務関係と共に、残余財産の帰属権利者に引き渡したときに終了する。
: The liquidation procedure in the trust by the trustee terminates when the trustee deliver over the all asset of the trust with all claim and obligation to the holder of vested right of the residual asset.
７、残余財産の帰属権利者 : The holder of vested right of the residual asset
本信託の残余財産の帰属権利者は、終了時の受益者とする。
: The holder of vested right of the residual asset in the trust is the last beneficiary.
これは登記記録に記録されている事項の全部を証明した書面である。

１、土地の所有者にお金を貸した金融機関は抵当権を設定しました。
２、金融機関は委託者として、抵当権のみを受託者の信託会社に信託しました。抵当権設定とは別に２回に分けて登記したので抵当権移転となりました。
３、信託が終了して、金融機関は元の抵当権者に戻りました、の登記。
