プラスの財産とマイナスの財産（仮訳）限定承認

親が亡くなって遺産が入ると思っていたら、何と借金ばかりだった・・・。
でも怒ってばかりはいられません。相続開始を知ってから３ヶ月を過ぎると、単純承継といって、借金や債務までも一切を含めた遺産を引き継がなければならなくなるからです。親の残した借金に苦しめられそうな場合、相続人はどのような手を打てるのでしょうか。
You thought that you succeed to your parent’s property.
But your parent’s only left you obligation.
You can’t angry forever.
If three months have passed you know the succession, you should succeed to the property and the obligation. It is called unqualified acceptance.
If you don’t want to succeed to the parent’s obligation, what process do you take?
プラスかマイナスか不明の場合、または借金が多いと予想される場合は「限定承認」を
When you don’t know decedent’s substance of property or you expect that you succeed to obligation, you may proceed qualified acceptance.
仮に遺産の総額が１億円で、借金が１億２０００万円だった場合、限定承認をすればこの２０００万円については責任を負わなくてもよいことになる方法です。
The property is \100.000.000.00 and obligation is \120.000.000.00.
If you make qualified acceptance, you can perform whole parent’s obligation at the \100.000.000.00.
つまり、相続によって得た財産の限度で債務を弁済する相続の形です。この限定承認をするためには、相続開始があったことを知ってから３ヶ月以内に、被相続人の住んでいた地域を管轄する家庭裁判所に申立てをします。
The qualified acceptance is inheritance to perform the obligation by obtained property.
The heir effect qualified acceptance to the family court within three months of the time he/she has knowledge that three has been a commencement of inheritance for him/her.
限定承認は、相続人全員の意思が一致していなければなりません。また、ひとたび限定承認の申立てが受理されると、撤回することはできません。
If there are two or more heirs, qualified acceptance may only be made if all members of the joint heirs make qualified acceptance jointly.
The qualified acceptance may not be revoked.
