If you succeed the real property, the register first.

登記をせずに放っておくと、権利関係が複雑になる。

If you leave the registry undone, the right become complex.

たとえば、被相続人の残した不動産について、相続人Ａ、Ｂ、Ｃの間でＡが相続するということで話し合いがうまくまとまったので、安心して放置しておいたら、相続人の一人であるＣが亡くなってしまったというケースは意外と多くあります。

For example, the heirs leave the registry that is the ancestor’s real property undone because A, B and C agreed that A inherits. There is the unexpected many cases that C dies at that time.

この場合、ただ話し合っただけだったとしたら、Ａの名義に登記するためには、亡くなったＣの相続人Ｄ,Ｅ、Ｆを加えてもう一度協議をしなければなりません。

In this case the talk about inheritance while C was alive disappeared, you agreed only, you should talk the ancestor’s real property over with B, D, E and F to register.

この協議がうまくまとまらないうちにＢが亡くなってしまったら、Ｂの相続人Ｇ、Ｈ、Ｉ、Ｊも協議に加えなくてはなりません。そうこうしているうちにＡが亡くなってしまったら・・・

B died, too when you don’t talk the real property over with B, D, E and F. You should talk the ancestor ‘real property over with G, H, I, J, D, E and F . In the meantime, if A die…….

長い間登記を放置しておくと、相続権のある人が次第に増えて、遺産分割協議が整うことが難しくなります。登記手続に必要な書類も多くなり、不動産をめぐる法律関係をさらに複雑にさせます。

If you leave the registry undone for a long time, the heir increase steadily. So, agreement to divide inheritance become difficulty. You should prepare the form more for the registry. The right of the real property become more complex.

⑭不動産を相続したら、まず登記（仮訳）
If you succeed the real property, the register first.

相続によって不動産を取得した場合、それが自分のものであることを他人に主張するために登記をするのであり、登記しなければ罰せられるというわけではありません。

If you succeed the real property, you register to assert your real property to the third parties. You don’t penalty without succession registration.

「相続権のある私たち以外に遺産が行くわけがない」と考える人もいるようです。しかし、これで本当に大丈夫でしょうか。

The person thinks the estate isn’t transferred from us to the third parties because we have inheritance. Is the thinking all right?

不動産をめぐる相続問題は、とかくスムーズにいかないことも多くあります。つまり登記をしておかないと、後々、困ることが起きるのが不動産相続の常識と考えておいたほうがよいでしょう。

The inheritance of real property doesn’t go smoothly at the most. So, If you don’t registry, you may have difficulty.

森林の荒廃が、環境を壊すことになる。

The forest that is ruined lead the natural environment to destroy.

山林の所有者が亡くなった場合に、相続登記をして所有者を明確にすることは、近年叫ばれる環境問題にも大きく関わりがあります。

We need to clear name of owner by the registration of inheritance when a mountain forest’s owner died. It is concerned with the natural environment.

全国には森林所有者が加入する森林組合があり、森林の手入れなどをお手伝いしてくれますが、所有者がわからないと手入れが行われなくなり、荒廃が進んでしまいます。

In Japan, there is the forest association that the forest’s owner enter. The association helps the care of forest. If the forest’s owner is unknown, the forest go to ruin. The association can’t care about the forest. 

間伐などで森林を健全な状態に保つことにより、水害や土砂崩れなどの災害が起きにくくなり、野生動物の住みやすい環境をつくるのです。

The owner cooperate with the association in the care of forest. The care may reduce the possibility of flood damage or landslide. The natural environment is livable for the wild animal.
